It's driving me crazy, can newsletter info in Profile be unitalicized? If so where?

Default Newsletter Registration...
What is the code to get that boxed to be checked automatically? Then they could uncheck it if they do not want to subscribe.

That is illegal...a customer has to physically check the box to opt in to a newsletter.
