I have been using the 4.0 line since about 4.0.1 and yes there are bugs but overall it seems to work pretty well. I am getting orders everyday and it keeps getting better and better with every release. Yes, I also can't wait until it is stable, but it is certainly not so bad that it is unuseable. At least not for me.

I can't find an upgrade utility from 3.5.14 to 4.0.10.
Is there one or else what can I do to upgrade without paying xcart.

No upgrade utility for that. I just upgraded from 3.5.4 to 4.0.9. I installed ver 4 on a brand new server (fresh install), modified and customized the cart, and then paid the X-Cart team to upgrade and transfer my databse to the new installation ($100.00). If there's a better way to upgrade, somebody please respond to this post.

I didn't know you could have them move the database to the new version - $100, that's worth it if true....
