Hey pairodimes, did you ever figure this out? I'm trying to do exactly the same thing. I need menus that stay static even when not in the catalog.

Alla,
In the example you give (the default X-cart install) cat23 is "Internet", which is a subcategory of "Books". In other words, there is no subcategory of "Internet", although you could add one.
Go up one level to "Books" and you will see "Internet" and "Software" listed as subcategories.
