An other thought, is it OK with the license to install and run a none public version of 4.0.x alongside 3.5.14 while preparing for the switchover? Better ask before doing somethings that might violating the license

Its been discussed numerous times and it is well known that it is legal to run one non public development copy of X-Cart per each license that you have.
