This may be a bug in your X-Cart version. Is it 5.2.6, right?
In my local installation (the most recent 5.2.10) it works without any issues:
1. I untick the "Required" checkbox and disable the field be turning the green icon on the left into gray (

2. The field disappears from the checkout page (
