If you have a global attribute, you must be able to filter by it even though some product may not have it specified. However, I would agree that you should have had an option "Unspecified" in this case.

As for more sophisticated solution, when product filter only contains available options for the product that were already filtered (i.e. do not allow to filter by manufacturer those 3 products), I agree, it is a great suggestion, but it will require Product filter rework. Anyway, I will add it to our TODO list.
