Firstly welcome to x-cart!
The system automatically sends emails to the client at various stages of the order process, depending on what you have set in Email Notifications.
So they get an email when they place the order, and then when you process and/or complete it.
These emails all contain a copy of the invoice. This is all done through the email templates in skin1/mail/html.
So it's just a case of editing one and adding the terms text to the email.
